Terms & Conditions

These are the terms and conditions for the website www.thediggwhizz.com. If you intend to use this website or engage with any of its products or services, then you will need to agree to the following terms and conditions. Please make sure you read them carefully.

The website www.thediggwhizz.com including its URL are owned and operated by Stebrigra Company Limited, with offices in Kenya.

Our obligations

  1. In consideration for your payment in full, then we shall provide the digital marketing services which have been requested in accordance with this agreement. Failure or payment on the correct due date means that all services shall be suspended until the payment has been made in full and in advance.
  2. We will provide the digital marketing services using reasonable care and skill.
  3. The services shall be delivered to agreed deadlines where this has been specified.
  4. We agree to comply with any special requirements which may have been outlined as part of a brief.

Client obligations

  1. You will agree to register for an account to be able to fully access the services at www.thediggwhizz.com.
  2. You will agree to provide us as subcontractors with access to the correct information and documentation which we may need to carry out the digital marketing services and to fulfil our obligations under this agreement.
  3. You will agree to comply with any special conditions which have been detailed in the quotation as well as any subsequent discussions.
  4. You will pay all invoices promptly and acknowledge that no services can be carried out until invoices have been paid in full.

Payments

  1. You agree to pay the pay for the digital marketing services in accordance with the payment schedule, and will pay all invoices in full ahead of your work being carried out.
  2. If any sums which are due to us are not paid by the due date, then we will not be able to carry out any of the agreed services until these sums have been paid in full.
  3. Costs for website design and development projects are due in full and in advance of the project's beginning.
  4. Digital marketing payments for example social media management or PPC campaigns will be charged for a set amount of time – ie for a campaign lasting three months – and this will be due ahead of the three months commencing. If you want to renew or extend the contract then this can be done at any time.
  5. Payments from both Visa and Mastercard are accepted forms of payment and all payments are processed by a secure third party.

Warranties and indemnities

  1. You warrant that all materials shall be accurate and up to date when you submit them as part of a brief, and when these materials may cease to be accurate or up to date then you will supply us with updated forms of materials.
  2. You warrant that our use of the materials in connection with the provision of the services shall not infringe on the intellectual property rights of any other person or parties.
  3. You indemnify and hold us fully harmless from and against all claims, liabilities, losses, damages, and expenses which could arise out of or be based upon any breach of warranty under this agreement.

5.Limitation of Liability

  1. Save for any claim for breach of any warranty given in this agreement or pursuant to any indemnity given in this agreement, neither party shall have any liability to the other whatsoever under or in connection with this agreement for any of the following:
    a) Loss of profits or anticipated savings
    b) Loss of revenue
    c) Loss of or damage to reputation and/or goodwill
    d) Loss of opportunity
    e) Wasted management or other staff time
    f) Losses or liabilities under or in relation to any other contract
    g) For any other indirect, consequential and/or special loss or damage

6. Cancellations, terminations and refunds

  1. Clients may cancel their agreement with us at any time by either removing their registered account, or by getting in touch with us in writing.
  2. We may cancel or terminate a customer account at any time and without prior notice in the event we suspect that the client account may have violated any of these terms and conditions.
  3. Customers may not cancel a service when work has already begun, and if they attempt to cancel a service before this has been completed then they will still be liable foe the full costs of this service.
  4. We do not accept refunds as part of our terms and conditions.
